The present General Terms and Conditions (hereinafter referred to as “GTC”) define the terms and conditions of NESTTA-CIPŐ Kft. (registered office: 4400 Nyíregyháza Simai u. 4., Cg.: 15 09 079194, tax number: 23895766-2-15), the terms and conditions of use of the website and online store www.lourdeskids.com (hereinafter referred to as the “website”), which is exclusively owned and operated by the company. A User is any natural or legal person of legal age, or any unincorporated business or other entity, who registers on the Website. (hereinafter referred to as “the user”).

Please read this document carefully before using the site.

  • Subject of the contract

The subject of the contract is all products on the website www.lourdeskids.com. You can find out the properties and characteristics of the products in the product descriptions.

These GTC apply to all e-commerce services provided in Hungary through the online interface on the website www.lourdeskids.com.

Purchases made on the www.lourdeskids.com website are subject to the provisions of the Act on electronic commerce services, certain aspects of information society services of 2001. CVIII. Act (hereinafter: Ektv.) shall apply.

  • The seller

The seller for all products is Nestta-Cipő Kft. All objections and complaints regarding the product can only be made to Nestta-Cipő Kft. as the seller.

  • Steps to electronic contracting

Only registered users can make purchases on the website. The registration is done automatically during the purchase by filling in a real e-mail address and other data (billing/delivery address, phone number, comments) necessary to complete the order.

The seller shall not be liable for any delivery delays or other problems or errors resulting from incorrect or inaccurate information.

You can modify the details of your pending order by sending an e-mail to info@lourdeskids.com within 24 hours of placing the order.

Purchases on the website may be made by placing an order electronically, as set out in these GTC, as follows:

Placing an order is not a contract, it is an offer by the user to purchase the product. The seller shall confirm the order within 48 hours of its dispatch at the latest, which confirmation shall create a contractual relationship between the parties. Once the confirmation is sent, the order is considered a written contract. The language of the contract will be Hungarian or English, depending on the language choice of the customer.

Confirmed contracts shall be registered by the seller and shall constitute a written contract, which the seller shall keep for 5 years.

4) Purchase price, payment terms
The price shown next to the product on the website is the purchase price of the product, including VAT.
In the event that, despite the seller’s best efforts, an incorrect price is indicated on the website, in particular a price that is obviously incorrect, the seller is not obliged to sell the product at the incorrect price. In this case, the seller may offer to sell at the actual price and, if the user does not consider this acceptable, may withdraw his/her intention to buy.

5) Terms of delivery
The delivery time, if the product is in stock, is 2-5 working days from the day after the order is placed.
For products that are temporarily out of stock (custom-made products), the seller will send an e-mail notification of the expected delivery time to the e-mail address provided in the user’s order. In the light of the expected delivery time, the User shall be entitled to decide whether to continue to place an order.
If, in the light of the expected delivery time, the user decides not to maintain his order, he has the right to withdraw from the contract, but must send his withdrawal to the seller no later than 24 hours after “receipt” of the information on the expected delivery time. If the user is in default in sending this notice of withdrawal, the seller shall be liable to compensate all the damage suffered by the user as a result.
The User acknowledges that if the User does not expressly notify the Seller of its intention to withdraw within the time limit specified, the Seller shall consider the expected delivery time as accepted and shall arrange for the purchase of the product.
Custom-made products ordered individually can be returned only and exclusively due to a quality defect in the manufacturing process.
In all cases, the costs of re-delivery due to the failure of the delivery due to the fault of the user shall be borne by the user.

6) Exchange of goods, warranty
If the product ordered is defective in quality or damaged in transit, the seller will repair or replace it free of charge. In case the user does not wish to use this option, he/she may request an appropriate discount from the seller or withdraw from the contract. Cancellation for non-manufacturing or non-quality defects is possible up to 8 days from the date of delivery. In the event of cancellation, the seller will refund the purchase price of the product by bank transfer within 30 days or send it in the form of a redeemable online coupon within 5 days, at the user’s discretion.
Warranty claims are governed by the Civil Code 1959. IV. the provisions of the Act shall apply.
The seller draws the user’s attention to the fact that all products displayed on the website are individually handmade from genuine vegetable tanned leather of animal origin, which requires special care during use. The user is responsible for any damage caused by water, rain, environmental influences or improper use.

7) Right to withdraw from the purchase
In accordance with Government Decree 17/1999 (II.5.) on Distance Contracts, the user has the right to withdraw from the purchase within 8 (eight) working days of receipt of the ordered product without giving any reason, by returning the invoice received with the product to the seller in its original condition. In the event of withdrawal, the cost of returning the product shall be borne by the user, unless the seller provides otherwise. In any case, damages resulting from improper use of the goods must be compensated.
In the event of withdrawal, the seller will refund the purchase price paid by bank transfer within 30 days of withdrawal at the latest. In case of withdrawal, the seller will not refund the cost of delivery of the product (if any).

8) Data protection
The seller will keep the data in its possession confidential and will use it only for the purposes of fulfilling orders and making purchases. It will not disclose data to third parties, except to a subcontractor used in the performance of the contract. When processing the data, we comply with the provisions of the 2011 Act on the Right to Informational Self-Determination and Freedom of Information. CXII. the provisions of the Act shall apply.
The seller reserves the right to send e-mail messages to users for administrative and advertising purposes. You can unsubscribe at any time by clicking on the unsubscribe link at the bottom of the message.

9) Intellectual property rights
All data on www.lourdeskids.com is the exclusive property of the seller. Copying, distributing, broadcasting, posting, linking or altering the site is only possible with the prior permission of the seller. Violation of the above constitutes an infringement of copyright, trademarks or other intellectual property rights, which may result in civil or criminal liability for the user.
10) Final provisions

The Seller is entitled to unilaterally modify these GTC at any time, the modification made by the Seller shall enter into force at the same time as it is published on the website.
The contracting parties stipulate that they shall primarily try to settle any disputes that may arise in an amicable manner, and if the amicable negotiations do not lead to a result, the parties stipulate that the Nyíregyháza District Court shall have exclusive jurisdiction to settle any disputes.
